Mag - in that case, the COULD have let him sleep - wouldn't have mattered.
Just read another. They let the guy sleep, the cops didn't "lie about any evidence" - purely by the book. Miranda, everything. They then used the polygraph results while questioning him later - he confesses based on his failed Poly - and they courts held that it was an involuntary statement because of introducing polygraph results.
What pisses me off here is that we are not talking about wrongly accused persons, we are talking about people who are guilty as hell and admit to it, but get off on these tiny technicalities - and it is nearly impossible to have a completely glitch free investigation...
Another guy was mirandized verbally - but not on a form - later claims he wasn't mirandized and since the cops didn't have a written waiver, his confession was tossed.
I hate the MT Supreme Court. Bunch of lame-o cop hating criminal protecting jack-arses. twisted. i'm with you, but there are different perspectives you have to learn to see.
