I warned them about this in the past. Scrap Yard is opening themselves up to liability by charging to accept PayPal. It is against the PayPal terms of service, and if they find out, they can close your account among other things. I know people do this on BF too, but they’re not supposed to.
From PayPal terms of service:
4.6 No Surcharges. You agree that you will not impose a surcharge or any other fee for accepting PayPal as a payment method. You may charge a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge and is not higher than the handling fee you charge for non-PayPal transactions.
9.1 Restricted Activities. In connection with your use of our website, your Account, or the Services, or in the course of your interactions with PayPal, a User or a third party, you will not:
1. Breach this Agreement, the Card Processing Agreement, the Acceptable Use Policy or any other agreement that you have entered into with PayPal (including a Policy);

10.2 Actions by PayPal. If we have reason to believe that you have engaged in any Restricted Activities, we may take various actions to protect PayPal, eBay, a User, a third party, or you from Reversals, Chargebacks, Claims, fees, fines, penalties and any other liability. The actions we may take include but are not limited to the following:
1. We may close, suspend, or limit your access to your Account or the Services (such as limiting access to any of your Payment Sources, and your ability to send money, make withdrawals, or remove financial Information); 2. We may contact buyers who have purchased goods or services from you, contact your bank or credit card issuer, and warn other Users, law enforcement, or impacted third parties of your actions; 3. We may update inaccurate Information you provided us; 4. We may refuse to provide our Services to you in the future; 5. We may hold your funds for up to 180 Days if reasonably needed to protect against the risk of liability; and 6. We may take legal action against you.
PayPal, in its sole discretion, reserves the right to terminate this Agreement, access to its website, or access to the Service for any reason and at any time upon notice to you and payment to you of any unrestricted funds held in custody for you.
10.6 Acceptable Use Policy Violation - User Fines. If you violate the Acceptable Use Policy then we may hold your funds up to 180 Days, fine you up to $2,500.00 USD for each such violation and take legal action against you to recover additional losses we incur. You acknowledge and agree that a fine up to $2,500.00 USD is presently a reasonable minimum estimate of PayPal's damages, considering all currently existing circumstances, including the relationship of the sum to the range of harm to PayPal that reasonably could be anticipated and the anticipation that proof of actual damages may be impractical or extremely difficult. PayPal may deduct such fines directly from any existing Balance in the offending Account, or any other PayPal Account you control.

The answer is " they can't" and they don't care as long as they make money. Same as Ebay and their rules and regs. <img src="/ubbthreads/images/graemlins/eek.gif" alt="" />

I can appreciate their stand on this as I ship worldwide on a daily basis. It also cost SY for " handling" . There are also hidden costs like folks that give wrong address. The time it takes your help to contact customers on billing details etc. I even had one character ( after paying for several thousand dollar item) not be availible for delivery ( three attempts)!! This was out of contry so they shipped the unit back. Next - he had return shipping PLUS shipping back to him again and handling fees. He complained at the amount for handling AFTER he blew it. I am quite sure that SY deals with some of this. I do not accept paypal or cc and have been in business for 30 years. I am also prehistoric so you need take that into account. As the economy marches downward I can imagine you will see more and more of vendors tightening the clamps as they will be forced to do so.

Yep- still $14.95. I hear the post is going up again too. Not because of the price of fuel - but beacuse that is just what they do. If they cannot accomplish what need be done- they merely raise the price. Interesting concept but won't fly in my business. I received my tan first- now I understand that my black is on the way with the LE to follow. All told I think SY is doing a great job. I also think this board had much to do with the success. But- what do I know- I am a mere " Scrapper" Thanks Bruce- always enjoy the exchange

Moreover, any purchaser who uses PayPal should be prepared to have to pay a reasonable surcharge to cover the transaction fees. Why? Because regardless of the rules, that's the way it works in the real world. Actually, PP told me one of the reasons they have that rule is it's against federal law. You can't charge the customer for the fee, it has to be figured into the cost of the item, or chalked up to a cost of doing business. They said it's the same with sellers who accept credit cards and have a merchant account. They have to pay fees for that, but they also can't charge customers for the fee. I've been to gas stations before and bought a Coke with a CC, and they've let me have it free before, because with the merchant fees, it would have cost them more than giving it to me free. They don't do it often though, or everyone would figure it out and try to get stuff for free. <img src="/ubbthreads/images/graemlins/laugh.gif" alt="" /> This is also why some companies won't accept CC unless the purchase is $20+ etc. PayPal said the only way around the law, is to word it as having a set price, but offer a "cash discount" if not paying with an electronic payment method or CC. That way it's the same as, but different legal wording to keep out of trouble with the law.

I don't think so Bruce. With the economy slipping into am all time slump-I don't think there is enough enforcement to take care of anything much less surcharge or abuse by Ebay. Stock up on Guns & Knives and if it gets real bad out there head north and I"ll give you coordinates to my stronghold here in Oregon. <img src="/ubbthreads/images/graemlins/thumbup.gif" alt="" />
